Safe ATV Riding In Southern California ~

ATVs.jpgThe Consumer Product Safety Commission (CPSC) is warning All-Terrain Vehicle (ATV) riders to take necessary precautions to stay safe now that the ATV riding season has kicked into gear.

With increased riding comes the increase in deaths. In April, there were media reports of at least 40 fatalities, 12 involving children younger than 16 years old.

The CPSC data indicates that ATV-related deaths jump an average of 30% from March to April for children younger than 16. Adult deaths increase 88 percent on average during the same time frame. In 2003-2005, ATV-related deaths rose each month during the spring and into the summer, peaking in July. On average, 23 children and 76 adults were killed in ATV-related incidents.

CPSC Chairman Inez Tenenbaum stated that "far too many people are losing their lives and sustaining life-threatening injuries, which in many cases are preventable. CPSC is working diligently to ensure that the ATVs on the market meet mandatory standards and to promote safe riding practices."

In April 2009, it became mandatory for ATV manufacturers and distributors to offer free, hands-on training through their dealers to first-time purchasers as well as age appropriate members of their immediate families, within a reasonable time from purchase.

Roller Blading Safely In San Diego ~

Southern California's warm and dry climate offers an excellent area for numerous outdoor activities, and San Diego is no exception. Our County offers many places to roller blade.

Roller blader.jpgSan Diego County roads have marked bike lanes which are suitable for the experienced road skater. However, in California, it is illegal to roller blade on streets, including bike lanes, because roller bladers are classified as pedestrians. Be aware that the City of San Diego adheres to this strict interpretation if you choose to skate within the city limits. However, if you skate responsibly, enforcement is rare.

In order to have fun while roller blading, one must be safe at all times. Roller bladers should be extremely observant for bicyclists, pedestrians, skateboarders, and motorists while enjoying the activity.

Former Padres Player Settles Wrongful Death Case

The following is a guest post by the Chicago wrongful death lawyers at Dolan Law Offices:

Jim Leyritz, who helped the San Diego Padres reach the World Series in 1998, has settled his wrongful death lawsuit with the family of a Florida woman whom he killed in a 2007 drunk driving accident.

Leyritz allegedly ran a red light early one morning after he had been out drinking to celebrate his 44th birthday. He crashed into the car driven by Fredia Ann Veitch. Veitch was also drunk at the time of the accident.

According to the terms of the settlement, Leyritz will pay $350,000 to the Veitch family. $250,000 will be paid by the insurance company and $1,000 per month will be paid to the family over the next 100 months from Leytritz's own accounts.

Leyritz's criminal trial is scheduled to start in July of this year. He is charged with DUI manslaughter and, if convicted, he faces a potential ten years in prison.

During his baseball career Jim Leyritz played for the San Diego Padres, New York Yankees, Boston Red Sox, Anaheim Angels, Texas Rangers and Los Angeles Dodgers.

Toyota Deaths Now Total 89 ~

The National Highway Transportation Safety Administration has raised the number of deaths associated with Toyota acceleration to 89. According to the AP, the NHTSA reported this week that 89 deaths in the past ten years can be attributed to "unintended acceleration in Toyota vehicles." Further, It states that according to the NHTSA: "From 2000 to mid-May, [Toyota] had received more than 6,200 complaints involving sudden acceleration in [its] vehicles. The reports involve 89 deaths and 57 injuries over the same period. Previously, 52 deaths were blamed on the problem."

Bloomberg News reports that yesterday in Los Angeles, Superior Court Judge Carl West heard arguments regarding whether 21 lawsuits should be grouped together (Toyota Motor Cases, Case No. JCCP4621, Superior Court of California {Los Angeles}). The cases include a class-action lawsuit brought by the Orange County District Attorney and a lawsuit by the family of a California Highway Patrol officer who died in a crash in San Diego. Judge West stated: "Lawsuits in California state court against Toyota Motor Corporation related to sudden acceleration of its vehicles should be coordinated so they can be handled more efficiently." He plans to recommend to the California Supreme Court Chief Justice that the lawsuits should be coordinated in either Orange County or Los Angeles, California. He also said he recommends the personal injury lawsuits proceed either as a separate group before the same judge, or in one group on separate tracks with the class-action lawsuits.

The world's largest automaker faces at least 228 federal and 99 state lawsuits, including proposed class actions, allegedly caused by sudden-acceleration incidents. On April 9th, the federal lawsuits were combined before U.S. District Judge James V. Selna in Santa Ana, California.

Lisa Gilford, a lawyer who represents Toyota, commented at yesterday's hearing that Toyota would prefer to have one coordinated proceeding for the state court cases in Orange County, because the federal cases are already there.

California Pool Safety Campaign Kick-Off ~

Today, the U.S. Consumer Product Safety Commission kicked off the Pool Safely campaign (www.poolsafely.gov). This is a first-of-its-kind national public education effort to reduce child drownings, and non-fatal submersions and entrapments in swimming pools and spas.

The Pool Safely campaign will start off with a national conversation with parents and children, pool owners and operators, and industry professionals about the simple safety steps they can take to protect themselves and their families in and around pools and spas. Pool & spa incidents are preventable, so the mission is to change the way families think and act about pool and spa safety.2 Boys In Pool.jpgSafety in the water comes with adopting and practicing as many water safety measures as possible, including: learning and practicing water safety skills (knowing how to swim and perform CPR); installing barriers that completely surround the pool & spa with self-closing, self-latching gates; staying close, being alert, and watching children while in the pool and/or spa; and having the appropriate pool/spa equipment in place (i.e., compliant drain covers, alarms, sensors, and barriers).

Statistics reveal that from 2005 to 2007, there was an annual average of 385 pool and spa-related drownings of children younger than 15. Approximately 78 percent of these (299) were children younger than five years old.

Then from 2007 to 2009, the estimated annual average was 4,200 pool or spa emergency department-treated submersions for children younger than 15, with children between the ages of 12 to 35 months representing 47 percent of the estimated injuries for those years.

Approximately 54 percent of the estimated injuries for 2007 to 2009 and 74 percent of the fatalities from 2005 to 2007 involving children younger than fifteen occurred at a residence. Most of the reported fatalities occurred on the day of or within a week of the submersion incident. Only four percent of fatal victims survived beyond a week from the submersion. These victims sustained severe injuries and required intensive medical care and treatment.

Recall Of Junk Food Clothing Company Hooded Sweatshirts ~

Junk Food Clothing Company of Los Angeles, California, in cooperation with the U.S. Consumer Product Safety Commission, recently announced a voluntary recall of its
children's hooded sweatshirts with drawstrings due to a strangulation hazard. Approximately 24,000 were manufactured.

The hooded sweatshirts have a drawstring at the neck that poses a strangulation hazard to children. This recall involves all children's pull-over and zippered hooded sweatshirts with drawstrings sold under the "Junk Food" brand name. The sweatshirts were sold in a variety of print designs and in children's sizes small, medium, large and extra-large. T

The sweatshirts were sold at retail outlets and department stores nationwide between June 2006 and August 2009 for approximately $35.00.

Consumers should immediately remove the drawstrings from the sweatshirts to eliminate the strangulation hazard, or return the product to the store where purchased for a refund.

Crash Hazard Recall Of Niner Bikes ~

Niner Bikes of North Hollywood, California, in cooperation with the U.S. Consumer Product Safety Commission, announced a voluntary recall of the following consumer product. Bicyclists should stop using the recalled product immediately.

The hazard is due to a welding deficiency which can cause the bicycle frames to crack along the welds of the front triangle. This can then cause the rider to lose control and crash. So far, the company has received 53 reports of cracks along the welds while the bicycles were being used.

The recalled frames include all Jet 9 models (ranging sequentially from P8001682 to P9400454). The frame is a full suspension model which was manufactured in white, green, or black. Both "Jet 9" and "Niner" are painted on the bicycle frame, which was made from 6000 series aluminum.Niner bike frame.jpgThe bicycles were sold at bicycle stores nationwide and overseas from March 2008 through September 2009 for approximately $1,750.00.

Safety Recall Of Family Dollar Stores' Toy Dart Gun Sets Due To Deaths

The U.S. Consumer Product Safety Commission (CPSC), in cooperation with Family Dollar Stores Inc., of Charlotte, N.C., announced a voluntary recall of 1.8 million toy dart gun sets due to an aspiration hazard.

The CPSC and Family Dollar received reports of two asphyxiation deaths involving a 9-year-old boy in Chicago, Illinois and a 10-year-old boy in Milwaukee, Wisconsin.

According to the CPSC, "if a child places the soft, pliable plastic toy dart in his/her mouth, the toy can be inhaled into the throat and prevent the child from breathing."

The "Auto Fire" toy target set is sold with either an orange and yellow toy gun (item #P238) or a blue and yellow toy gun (item #9328), eight orange darts and a small target with numbers from 1 to 20. The gun's item number is located on one side of the handle in raised lettering. The soft plastic darts measure just over one inch in length and have a small suction cup at one end with a diameter of about ½ inch. The target board is black, yellow, red and green, and measures five inches in diameter. "Gordy Toy" for "Ages 8+" is printed on the packaging."

"The toy sets were sold exclusively at Family Dollar stores nationwide from September 2005 through January 2009 for about $1.50."

Consumers should immediately remove the toy target sets from children and either discard them or return them to a Family Dollar store for a full refund. Keeping Our San Diego Roadways Safe ~

With today's technology of using cell phones in our vehicles, roadside call boxes are not the preferred choice to use in time of need. Did you know, though, that in case the need arises, call boxes are placed at intervals of either a half-mile or one mile apart on our San Diego roads? San Diego SAFE is in charge of maintaining and placing roadway call boxes in San Diego County.

In the event of a freeway or roadway crash, you have the option of using one of the call boxes to call for help or call for a tow truck to assist you.

SAFE operates & maintains a system of freeway and rural stateway highway call boxes. SAFE forms a network of cellular telephones designed especially to link San Diego County's more than 280 miles of freeways and 255 rural state highways to the California Highway Patrol (CHP).

For motorists with automobile failure or other roadside emergencies, assistance is available from police, fire, ambulance, towing, and other service personnel - or even from a family member or friend. Motorists simply raise the handset of a call box and press the red "call" button. The telephone connects the motorist directly to a trained dispatcher, who will ensure that the appropriate roadside services are made available to stranded motorists.

Driven To Safety ~ Auto Safety Innovations Spurred By Litigation

The American Association For Justice has authored a new report entitled "Driven to Safety: How Litigation Spurred Auto Safety Innovations."

The essence of the report is that in the aftermath of the Toyota sudden acceleration scandal, automobile safety is now a hot-button issue. Internal Toyota documents showed it knew about the potential defects, hid the defects from regulators, and even bragged about the money it was saving by limiting vehicle recalls. The fine levied against Toyota was the largest one ever against an auto manufacturer.

50 deaths and 8.5 million recalled cars later, the Toyota saga is yet one more example that regulation is an incomplete safeguard when auto manufacturers put their profits over public safety. The sad reality is that auto manufacturers have been doing this for decades.

Court cases from the 1960's began highlighting the dangers of auto design and the willful negligence of auto manufacturers in designing vehicles known to be unsafe. Since then, our the civil justice system has worked hand-in-hand with regulation to protect Americans, all the while spurring generations of safety innovations.

Toyota Lawsuits Focus On Diminished Vehicle Values

According to the National Law Journal and the Financial Times, plaintiffs could seek $7.35 billion in Toyota diminished-value litigation in the upcoming months.

The National Law Journal (5/13, Bronstad) reports: "Plaintiffs' counsel could seek as much as $7.35 billion from Toyota Motor Co. to compensate consumers for the diminished value of their vehicles in light of problems with sudden unintended acceleration, one of those lawyers said on Wednesday."

Speaking at a full-day conference in California which was organized by scores of the plaintiffs' firms in the multidistrict litigation (MDL) against Toyota, attorney W. Daniel Miles III with a firm in Montgomery, Alabama said: "I think we're blazing a new trail."

Toyota plaintiffs "will enjoy some distinct advantages over other tort actions arising from consumer contracts," said Miles, noting that "several consumer ratings agencies have issued hard estimates that Toyota vehicles have declined in value by between 2.6% and 3.77%."

Mission Bay ~ San Diego Motorcycle Crash

According to the San Diego Police, early this morning in Mission Bay, a 29-year old man died after crashing his speeding 2004 BMW motorcycle into several parked cars.
BMW Motorcycle Crash.jpgThe crash occurred in front of the Bahia Resort Hotel on West Mission Bay Drive. His name was unavailable pending notification of his next of kin.

Riding a motorcycle is liberating, however the risks are substantial. Unfortunately, drivers frequently don't see motorcycles when they turn in front of them or pull out in front of them on our roads. As a result, motorcyclists are often involved in auto & motorcycle collisions which result in serious injury to the motorcyclist.

Many drivers have a prejudiced opinion of motorcycle riders, thus the rights of motorcyclists are often overlooked on both the road and in our court system.

What Should You Do After A Dog Bite Attack?

Seek medical treatment promptly. A dog bite may pose a serious risk of infection. Therefore, contact a doctor immediately for treatment. If the bite is serious and you or a loved one are in immediate medical distress, call an ambulance or go to an emergency room or urgent care facility as quickly as possible.

Identify the dog that bit you. Identify the dog that attacked you and determine how the dog owner can be located. The dog owner is the responsible party in a dog bite situation, and the dog owner's home insurance company is usually the entity that will pay for a dog bite injury.

Report the dog bite attack. Report the dog bite attack to your local county animal control agency or sheriff's department. Provide them with information about the dog, including the owner's name and address. If the dog is a stray, describe the appearance of the dog and the location of the attack.

Take photos of the dog bite injuries. Take photographs of all visible injuries, including lacerations and wounds. Also, take photos of any torn or bloody clothing. If possible, take photographs of the dog itself and where the bite occurred.

Brain Injuries In San Diego

What is Brain Injury?

May Is Motorcycle Safety Month In California

Did you know that May is Motorcycle Safety Month in California? Now that warmer weather is upon us, we will undoubtedly see higher numbers of motorcycles on our roadways. Therefore, a review of motorcyle safety tips is a good idea for all of us.

California Assembly Resolution ACR 43 lists the following facts and safety tips pertaining to safe motorcycle riding:

Motorcycle riding is a popular form of efficient transportation and recreation for more than 1,000,000 people in California;

Motorcycles provide a means of transportation that uses fewer resources, cause less wear and tear on public roadways, and increases available parking areas;

It is important that drivers of all vehicles be aware of one another and learn to share the road and practice courtesy;

It is especially important that the citizens of California be aware of motorcycles on the streets and highways and recognize the importance of motorcycle safety;

The safety hazards created by automobile operators who have not been educated to watch for motorcyclists on the streets and highways of California are of prime concern to motorcyclists;

The American Brotherhood Aimed Toward Education (ABATE) of California is an organization that is actively promoting the safe operation, increased rider training, and increased motorist awareness of motorcycles; and

It is important to recognize the need for awareness on the part of all drivers, especially with regard to sharing the road with motorcycles, and to honor motorcyclists' many contributions to the communities in which they live and ride.

52 Cows Dead ~ Cattle Truck Overturns On Redlands Freeway

Yesterday at approximately 2:30 p.m., a big rig truck transporting 146 cows flipped on its side on Interstate 10 near the University Street exit in San Bernardino County, closing the eastbound lanes for several hours. Officials report that 52 cows were killed in the crash and 94 remain alive.

San Bernardino County Animal Control Chief Brian Cronin says veterinarians are examining the animals while crews cut off the top of the trailer in order to remove the remaining live animals.

CHP investigators are investigating the cause of the crash.

"Huffing" Driver In San Diego Enters Not Guilty Plea

Yesterday, Romeo Dumlao entered a "not guilty" plea to gross vehicular manslaughter and other charges regarding a December 31st automobile crash in the Midway area of San Diego. Mr. Dumlao, driving an SUV, rear-ended a Toyota Camry being driven by Cindy Heffington. The Camry was totalled upon impact, and Dumlao's vehicle landed upside down. Cindy's 9-year-old daughter, Ashley, who was a passenger in the vehicle, subsequently died from head injuries caused by the crash after her parents took her off of life support.

Witnesses estimated Dumlao's speed from between 60 to 70 mph at the time of the crash, although the posted speed limit was 45 mph.

The testing of Dumlao's blood revealed two drugs: Prozac and tetrafluoroethane. Medical experts call the abuse of tetrafluoroethane "huffing." While investigating, police found several cans of the chemical in both Dumlao's car and apartment. "Huffing" is the inhalation of the propellant in aerosol cans to get high. Tetrafluoroethane is a chemical found in keyboard cleaners, etc. According to experts, certain effects occur when it is inhaled in a contained space (i.e., inside a car). "Because it's so readily absorbed into the pulmonary tissue where there's lots of blood vessels, it actually mimics somebody injecting another agent like heroin," said Dr. Shawn Evans of Sharp Memorial Hospital.

This case is being considered a test case for trying to prosecute someone for huffing. Dumlao is being held on $250,000 bail and faces 16 years in prison if convicted.

Baby Gap Swimsuit Recalls Due To Strangulation Hazard

Baby Gap Swimsuit2.jpgThe U.S. Consumer Product Safety Commission and Health Canada, in cooperation with Gap, Inc. of San Francisco, California, announced on April 30th a voluntary recall of baby swimsuits.

The baby swimsuits were sold in two styles from February to April 2010: 706260 (blue & white) and 700452 (red & white). The style numbers are located on the labels of the swimsuits. Both swimsuits were sold in infant sizes up to 24 months and are made of a synthetic knit stretch fabric of polyester and spandex. The straps contain the same material. Approximately 6,500 bathing suits were sold in the U.S., and approximately 480 in Canada.

The swimsuits were designed with too-short halter straps which cause the plastic ring located at the neck of the swimsuits to press against a child's throat, thereby obstructing breathing and posing a strangulation hazard to the child.

Consumers should immediately take the recalled swimsuits away from children and return them to either the babyGap, GapKids, Gap, Gap Outlet stores, or online at www.gap.com
for a refund.

Safety Recall Of Scuba Diving Buoyancy Compensators Due To Drowning Hazard

The U.S. Consumer Product Safety Commission, in cooperation with Ocean Management Systems Inc. of Middletown, New York, announced a voluntary recall of buoyancy compensators used while scuba diving. Divers should immediately stop using the recalled product.

The seal ring of the buoyancy compensator could crack, which poses a drowning hazard to divers. Buoyancy compensators provide buoyancy control for scuba divers by allowing them to inflate or deflate the devices. The compensators were sold in black or red, with "OMS" printed on the front inside of the compensators.
Scuba seal ring.jpgThe buoyancy compensators were sold for approximately $400 at dive stores nationwide from May 2006 through August 2008.
