Spinal Cord Injury (SCI) is damage to the spinal cord that results in a loss of function such as mobility or feeling. Frequent causes of damage are trauma (car accidents, gunshot wounds, falls, etc.) or disease (polio, spina bifida, Friedreich's Ataxia, etc.). sci_over.jpg
The spinal cord does not have to be severed in order for a loss of functioning to occur. In fact, for most people with SCI, the spinal cord is intact, but the damage to it results in loss of functioning.

Almost 11,000 people in the U.S. sustain a traumatic spinal cord injury each year, resulting in temporary or permanent sensory deficit, motor deficit, or bowel or bladder dysfunction. In this country, more than 250,000 people live with paralysis caused by SCI.

More than half the people who sustain an SCI are between the ages of 16 and 30. More males than females sustain this type of injury - the ratio is more than four to one. The most common cause of SCI is a motor vehicle crash, accounting for at least 36% of these injuries (broken down as follows: no restraints used - 20%; restraints used - 13.7%; motorcycle - 7.4%; accidents involving pedestrians - 5.2%; other - 2.1%).

Violence-related SCIs have been steadily increasing over the past two decades, and today, violence is associated with 29% of SCIs. Falls and sports injuries result in 21% and 7% of SCI cases, respectively.

Damages In SCI Cases

The amount of damages that may be recovered against a party responsible for causing SCI injury is substantial. The average out-of-pocket cost of coping with a spinal cord injury in the first year can be as high as $741,000 for the most severe injuries. For each year after that, the average cost is approximately $132,000. These amounts don't include indirect damages (which averaged $60,000 in 2006) such as:

  • Lost wages

  • Pain and suffering

  • Loss of consortium

  • Loss of enjoyment of life

    Former Padres Player Settles Wrongful Death Case

    The following is a guest post by the Chicago wrongful death lawyers at Dolan Law Offices:

    Jim Leyritz, who helped the San Diego Padres reach the World Series in 1998, has settled his wrongful death lawsuit with the family of a Florida woman whom he killed in a 2007 drunk driving accident.

    Leyritz allegedly ran a red light early one morning after he had been out drinking to celebrate his 44th birthday. He crashed into the car driven by Fredia Ann Veitch. Veitch was also drunk at the time of the accident.

    According to the terms of the settlement, Leyritz will pay $350,000 to the Veitch family. $250,000 will be paid by the insurance company and $1,000 per month will be paid to the family over the next 100 months from Leytritz's own accounts.

    Leyritz's criminal trial is scheduled to start in July of this year. He is charged with DUI manslaughter and, if convicted, he faces a potential ten years in prison.

    During his baseball career Jim Leyritz played for the San Diego Padres, New York Yankees, Boston Red Sox, Anaheim Angels, Texas Rangers and Los Angeles Dodgers.

    Crash Hazard Recall Of Niner Bikes ~

    Niner Bikes of North Hollywood, California, in cooperation with the U.S. Consumer Product Safety Commission, announced a voluntary recall of the following consumer product. Bicyclists should stop using the recalled product immediately.

    The hazard is due to a welding deficiency which can cause the bicycle frames to crack along the welds of the front triangle. This can then cause the rider to lose control and crash. So far, the company has received 53 reports of cracks along the welds while the bicycles were being used.

    The recalled frames include all Jet 9 models (ranging sequentially from P8001682 to P9400454). The frame is a full suspension model which was manufactured in white, green, or black. Both "Jet 9" and "Niner" are painted on the bicycle frame, which was made from 6000 series aluminum.Niner bike frame.jpgThe bicycles were sold at bicycle stores nationwide and overseas from March 2008 through September 2009 for approximately $1,750.00.

    Minimizing NFL Brain Injuries

    This past February, the first NFL Brain Injury Group meeting was held in Palm Beach, Florida. The relationship between professional football and brain injury has been heavily discussed in the media during the past few months.

    In fact, the issue has even gone to Congress. Earlier this year, congressional hearings were held to look into the link between professional football and dementia, and other signs of brain injury. This was a follow-up to a compete hearing conducted last October in Washington, D.C. During that hearing, the NFL received severe criticism for the manner in which it has handled the issue of brain injuries in football players. NFL Commissioner Roger Goodell testified about his league's concussion policies. The league has since agreed to several changes in the rules to minimize the risk of brain injuries.

    The Mackey-White Traumatic Brain Injury Committee consists of professional athletes, current and past NFL players, doctors, and scientists. The committee was formed as a forum for discussion of brain injuries in professional football, the latest research linking injuries to football, as well as safety recommendations to prevent injuries.

    The Committee is named after athletes Reggie White, who died at the age of 43 after his retirement from professional football, and John Mackey, who suffers from Alzheimer's disease.

    California brain injury lawyers know that getting the NFL to admit that there is a high risk of brain injury caused by continuous blows to the head has been no easy task. The NFL's Dr. Ira Casson testified at the hearing earlier this year that there wasn't enough evidence to determine whether repeated head blows could cause long-term brain damage. However, in December 2009, an NFL spokesperson made a startling admission - that medical research had proved that repeated concussions can cause long-term problems.

    Brain Injuries Suffered In The NFL

    Football.jpgFootball is America's most popular sport, providing hours of enjoyable entertainment to avid fans. But it's not all fun and games for the players. Doctors believe head trauma suffered by football players while playing professional football may cause early onset dementia. Examinations of the brains of two now deceased players, Mike Webster and Andre Waters, revealed early onset dementia. Other former players currently suffer from similar injuries.

    Last month, former Pittsburgh Steeler and San Diego Charger Ralph Wenzel became the first former NFL player to file a workers compensation claim in a California court against the NFL for injuries resulting in dementia. His lawsuit will be closely watched by the NFL to determine what its liability will be, if any.

    HBO's sports magazine series "Real Sports" authored two stories regarding the NFL's long-adopted policy of ignoring concussions and allowing players back on the field immediately after sustaining a head injury.

    The NFL has been forced to examine the long-term effects of America's most popular sport and has implemented new policies regarding the treatment of head injuries and concussions. Players are required to sit on the bench after sustaining a head injury, and equipment improvements and limiting head-to-head contact have also been implemented.

    The long-term effects of the NFL's changes are unknown, but provide little support to former players who have already suffered injury. Of most importance is the recent revelation that any impact to the head causes some degree of brain damage. The damage may have less to do with extreme collisions than the cumulative effect of each seemingly harmless blow to the head suffered over the course of a player's career.
